General terms and conditions of the online shop
Effective from 20 September 2026. These terms govern purchases in the Totus online shop. They are drawn up in line with the Slovenian Consumer Protection Act (ZVPot-1), the Obligations Code (OZ), the Electronic Commerce Market Act (ZEPT) and data protection law.
1. The seller
The online shop is operated by Totus proizvodno in trgovsko podjetje, d.o.o. (short name Totus d.o.o.; hereinafter: the seller).
- Registered office and showroom: Tacenska cesta 25, 1210 Ljubljana-Šentvid
- Registration number: 5752655000
- VAT ID: SI31033890
- Managing director: Elvis Bassanese
- Company contact: info@totus.si, phone 041 388 100
- Online shop contact (orders, withdrawals, complaints): trgovina@totus.si, phone 041 676 857
- We are available Monday to Friday, 8:00–16:00.
2. Scope of the terms and buyers
The terms apply to every order placed in the online shop. Each order is governed by the terms published on the day the order is placed. By placing an order the buyer confirms that they have read the terms.
A buyer may be a consumer or a business buyer. A consumer is a natural person who buys goods for purposes outside their trade, business or profession. A business buyer is a legal entity, sole trader or other person who buys goods for their business. The rights granted by ZVPot-1 (in particular the 14-day right of withdrawal and the liability for conformity of goods) apply to consumers only; business buyers are subject to the Obligations Code and these terms.
No user account is needed to buy.
3. Offer and prices
- All prices are in euros (EUR) and include 22% VAT. The price excluding VAT is shown next to every price.
- The price published with the item at the moment the order is placed applies. Prices apply to orders placed in the online shop.
- The "manufacturer's list price", where shown, is the price from the manufacturer's current price list including VAT and is given for comparison only. It is neither a previous price charged by the seller nor a price reduction.
- The delivery charge is not included in the item price; it is shown in the basket before the order is placed.
- The seller may change prices without prior notice. A change does not affect orders that have already been confirmed.
- If a price is wrong because of an obvious error (for example a price-list import error or a typing error), the seller informs the buyer before dispatch and offers the purchase at the correct price. The buyer may accept or cancel the order free of charge; any amount already paid is refunded without delay.
- Photographs may be illustrative. The item name, item code (SKU) and description are decisive.
4. How to order
An order is placed in the following steps:
- The buyer adds items to the basket. Until the order is placed, the basket can be reviewed at any time, quantities changed and items removed.
- In the basket the buyer chooses delivery or collection and enters the order details: full name, e-mail address, optionally phone, company and a note, and for delivery the delivery address.
- Before the order is placed, the ordered items, subtotal, VAT, delivery charge and total amount payable are shown. Input errors can be corrected directly in the form until the order is placed.
- The order is placed with the "Place order with obligation to pay" button. A placed order is binding and entails an obligation to pay.
- When paying by card, the buyer is redirected to the secure payment page of the provider Stripe; after a successful payment a confirmation is sent by e-mail. When paying by pro-forma invoice, the buyer receives an e-mail acknowledging the order, followed by the pro-forma invoice with payment details.
5. Conclusion of the contract
The sales contract is concluded when the seller sends the order confirmation to the buyer's e-mail address. From then on, the prices and other terms of that order cannot change, except in the cases set out in these terms (obvious pricing error, item cannot be supplied).
If an item cannot be supplied, or cannot be supplied within a reasonable time, the seller informs the buyer without delay. The buyer may then cancel the order and the seller refunds any amount already paid within 14 days at the latest.
The contract (the order and its confirmation) is stored by the seller in electronic form; the buyer may request a copy at any time from trgovina@totus.si. The contract is concluded in Slovenian.
The buyer receives the invoice by e-mail or together with the goods. The buyer should check the invoice details and report any errors as soon as possible.
6. Payment
- By debit or credit card through the payment service provider Stripe. Payment takes place on the provider's secure payment page; the seller neither sees nor stores card data.
- By pro-forma invoice, with a bank transfer to the seller's account. The seller orders or dispatches the goods once payment has been received.
Card payment is the default. If card payment is unavailable or fails, the seller handles the order as a pro-forma order. A buyer who wishes to pay by pro-forma invoice should write to trgovina@totus.si.
Business buyers enter the company name in the "Company" field and their VAT ID or tax number in the note; the invoice is issued to the company.
The goods remain the seller's property until the purchase price has been paid in full.
7. Delivery and collection
- Delivery by GLS: 9,90 € per order; delivery is free for orders of 150,00 € or more.
- Collection from the showroom in Ljubljana is free of charge.
- We deliver to addresses in the Republic of Slovenia.
Most items are supplied from the manufacturer's central warehouse.
Estimated delivery: 5–10 working days · we confirm the date when you order.
Unless agreed otherwise, the seller delivers the goods within 30 days of the conclusion of the contract at the latest. Charges, lead times and receipt of the shipment are described in detail on the Delivery and payment page.
8. The consumer's right of withdrawal
A consumer may withdraw from the contract within 14 days of receiving the goods without giving any reason. The procedure, the withdrawal form, refunds and exceptions are described on the Returns and complaints page.
Business buyers have no statutory right of withdrawal; goods may be returned only by prior agreement with the seller.
9. Liability for conformity of goods and guarantee
The seller is liable to the consumer for any lack of conformity that exists at the time of delivery and becomes apparent within two years of delivery. The consumer must notify the seller of the lack of conformity within two months of the day it was discovered.
Items for which the manufacturer issues a guarantee are covered by the manufacturer's guarantee terms. The guarantee does not limit the consumer's rights under the liability for conformity of goods.
Business buyers are subject to the rules of the Obligations Code on liability for material defects. Details and the procedure are described on the Returns and complaints page.
10. Complaints
We accept complaints at trgovina@totus.si, by phone on 041 676 857 or in writing at the seller's address. We acknowledge receipt and reply within eight days at the latest.
11. Personal data protection
The seller processes buyers' personal data to fulfil the order, deliver the goods, issue the invoice and comply with legal obligations. Details are set out in the Privacy policy.
12. Out-of-court resolution of consumer disputes
The seller endeavours to resolve any dispute amicably.
In accordance with the statutory requirements, the seller does not recognise any provider of out-of-court consumer dispute resolution (IRPS) as competent to resolve a consumer dispute that a consumer could initiate under the Slovenian Out-of-Court Resolution of Consumer Disputes Act (ZIsRPS).
13. Applicable law and jurisdiction
Contracts concluded in the online shop are governed by the law of the Republic of Slovenia.
Disputes with consumers fall under the court that has jurisdiction according to the general rules. Disputes with business buyers fall under the court with subject-matter jurisdiction in Ljubljana.
14. Changes to the terms and validity
The seller may change the terms. Changes take effect when published on this page and do not affect orders already placed.
